It examines the context of the referendum in Greece in the summer of 2015 in view of theories of sovereignty and theories of judgment.

This paper explores the elusive dialectic between concentration and forgetfulness, consciousness and unconsciousness in spontaneous artistic creation favoured by artists and advocated by critics in Chinese art history, by examining texts on painting and tracing back to ancient Daoist philosophical ideas, in a comparison with Kantian and post-Kantian aesthetics. Although artistic spontaneity in classical Chinese aesthetics seems to share similarities with Kant’s account of spontaneity in the art of genius, the emphasis on unconsciousness is valued by classical Chinese artists and (...) critics inspired by the Daoist idea of ‘Wu Wei’ (acting without conscious intention or effort). As the Qing painter Wang Yuanqi (1642–1715) claimed when admitting his failure to copy the Yuan master Ni Zan (1301–1374), Ni Zan’s success in natural and untrammelled expression lies ‘in between having an intention and not having one’. A similar idea about the dialectic of consciousness and unconsciousness in artistic spontaneity was suggested by Heinrich von Kleist’s On the Marionette Theatre (1880), which demonstrated that while self-consciousness might disturb and hinder the naturalness of artistic expression and thus encourage affectation, it does not mean that there is no role for consciousness. Although the views on unconsciousness in art and the co-play of consciousness and unconscious in artistic creation by Schelling, Schiller, Goethe, and even Nietzsche might get inspirations from Kant’s hidden view of the unconscious, Kant’s emphasis on the harmonious cooperation between imagination and understanding disguises his inexplicit idea of the unconscious. This paper will demonstrate that while in both Classical Chinese and European cultural contexts, artists, critics and philosophers talk about the same elusive relation, the philosophical explanations of the same phenomenon are essentially distinctive. Das Wiskott-Aldrich-Syndrom (WAS), ein genetisch bedingter Immundefekt mit klinischer Manifestation im Kleinkindalter, wird voraussichtlich in näherer Zukunft erstmals versuchsweise durch eine somatische Gentherapie behandelt werden. Im vor- liegenden Beitrag werden die wichtigsten medizinisch-naturwissenschaftlichen Fakten dieses Krankheitsbildes sowie die bisherigen Erfahrungen mit somatischen Gentherapien bei anderen Immunmangelsyndromen ausführlich dargestellt. Sodann erfolgt eine ethische Analyse eines möglichen gentherapeutischen Eingriffs bei WAS-Patienten, bei der die spezifischen Aspekte des Wiskott-Aldrich-Syndroms – insbesondere die fast ausschließliche Betroffenheit von Kindern sowie die unterschiedlich aussichtsreiche Alter- nativoption einer (...) allogenen Knochenmarktransplantation–wesentliche Aspekte der Beurteilung sind. Im Ergebnis zeigt sich, dass ein gentherapeutischer Eingriff im vorliegenden Fall nicht im Rahmen einer Forschungsstudie, d.h. als Humanexperiment, gerechtfertigt werden kann, sondern allein als individueller Heilversuch. Gleichwohl las- sen die besonderen Risiken und die Innovativität eines solchen Eingriffs es notwendig erscheinen, diesen Heilversuch – anders als andere Heilbehandlungen mit bislang unerprobten Mitteln – in streng kontrollierter Form durchzuführen. Der neuartige Gedanke eines kontrollierten individuellen Heilversuchs zeichnet sich daher für den vorliegenden Fall, und womöglich auch für vergleichbare risikoreiche Behandlungsansätze namentlich im Bereich der Gentherapie, als geeignetes Instrument der Konzeption und Beurteilung ab. In searching for the origins of current conceptions of science in the history of physics, one encounters a remarkable phenomenon. A typical view today is that theoretical knowledge-claims have only relativized validity. Historically, however, this thesis was supported by proponents of a conception of nature that today is far from typical, a mechanistic conception within which natural phenomena were to be explained by the action of mechanically moved matter. Two of these proponents, Hermann von Helmholtz and his pupil Heinrich (...) Hertz, contributed significantly to the modernization of the conception of science. Paradigmatic for their common contribution to this development is the way in which they employed the concept of image. By considering the origin and the different meanings of this concept we may trace a line of development which begins with Helmholtz's original claim that a universally and forever valid theory provides a unique representation of nature. It continues with the realization that the status of scientific knowledge is capable of revision; and it arrives at Hertz's admission that a variety of theories over a domain of objects is possible, at least at times. In the article I discuss the philosophical premises of Kleist's literary work, focussing on the relationship between his conception of moral conscience and Kant's ethics.

Helmholtz initially ascribes more to theoretical knowledge than merely that it is a picture of the world: it penetrates even to the unobservable causes of the phenomena which he conceived throughout his career as matter set mechanically in motion. The introduction of the picture-concept in the 1860s to characterize scientific theories marks the beginning of the loss of a direct connection with the world. Theories now constitute only a representation of a law-like structure of the world but no longer shed (...) light on the objects themselves. Beginning in the late 1870s, this knowledge of laws takes on an increasingly hypothetical character. (shrink)

The purpose of this paper is to analyze what neo-Kantian Heinrich Rickert designates by the term ‘chaos’. I argue that using this term Rickert means infinite manifolds of human life experiences, that philosophers have to convert into ‘cosmos’ of theories by using concept formation. Rickert thinks that cognition orders chaos. I show that Rickert’s version of ‘chaos’ is different from the ones that were expressed by I. Kant, J. G. Herder, F. W. von Schelling, F. von Schlegel, and F. (...) Nietzsche. I also argue that ideas of I. Kant influenced the formation of Rickert’s ideas on chaos. (shrink)

Intellectual historians have rarely attended to the genre of fighting manuals, but these provide a new window on long-debated questions such as the relationship between Scholasticism and Humanism. This article offers a close comparison of the first known fencing manual, the 14-th century Liber de Arte Dimicatoria (Leeds, Royal Armouries FECHT 1, previously and better known as MS I.33), and the corpus of fighting manuals which underwent a remarkable expansion during the 15th and 16th centuries. While the former clearly shows (...) its origins in a scholastic background, the latter is mainly viewed as reflecting its humanist context. To this historiographical division corresponds a linguistic one: MS I.33 is a Latin text, while the rest of the corpus is mainly written in German and Italian. However, exceptions arise, amongst which, Heinrich von Gunterrodt’s Sciomachia et Hoplomachia: sive de Veris Principiis Artis Dimicatoriae (1579), the first text which explicitly refers to I.33. This article will compare these two texts, in order to interrogate their common relation to Scholasticism, namely the traditional frame of the knowledge within the medieval and early modern universities. The intent is to show that (at least some) Renaissance fight books include references to Scholasticism and to provide a better qualification of the nature of such references. The general hypothesis is that a large part of the texts―and products of culture―of the Renaissance that have been read, until recently, exclusively in relation to a humanist intellectual background can valuably be interpreted in the context of a Scholasticism that is still vivid during the period in question. In the autumn of 1667, the young Leibniz published a «new method» for the science of law. Producing a revised edition of that early work was to become his lifelong project, to the purpose of which he wrote, in the 1690s, a succession of new versions of most of its sections. The main reason for this enduring interest was probably the fact that the juridical part of the treatise was preceded with a more general one, encapsulating in a few pages (...) a systematic overview of the disciplines composing the baroque encyclopaedia, after the model of Johann Heinrich Alsted’s monumental Encyclopaedia septem tomis distincta. If Leibniz still depended on Alsted’s notion of philosophy as the «circle of disciplines», he deeply transformed that pre-Cartesian conception of knowledge by two decisive innovations: following Bacon, he defines each branch of demonstrative science as bearing on one single «quality», abstracted from the subjects in which it inheres; yet, contrary to Bacon, he no longer conceives of these qualities as the ultimate components of reality, but as those of our experience of it, marking the limit of the explanatory capacity of language. Georg Henrik von Wright was not only the first interpreter of Wittgenstein, who argued that Spengler’s work had reinforced and helped Wittgenstein to articulate his view of life, but also the first to consider seriously that Wittgenstein’s attitude to his times makes him unique among the great philosophers, that the philosophical problems which Wittgenstein was struggling, indeed his view of the nature of philosophy, were somehow connected with features of our culture or civilization. -/- In this paper I draw inspiration (...) and courage from Von Wright’s insistence that trying to understand Wittgenstein in relation to his times is a philosophic task in its own right in order to probe into a relatively obscure region in Wittgenstein’s thought: his relation to the music of his times. It is a topic, on which Von Wright, and most other prominent Wittgenstein scholars, have said very little, but it is also one, which Wittgenstein himself attested was so important to him that he felt without it he was sure to be misunderstood. -/- I offer textual and historical evidence in support of my claim that, parallel to Wittgenstein’s exposure to Spengler’s Decline of the West in 1930, he was also introduced to the music theory of Heinrich Schenker, which helped him to articulate, partly by way of critique, a complex and unique position concerning the modern music of his times, which exhibits his rejection of what Von Wright later dubbed ‘the myth of progress’. As Von Wright observed in other regions of Wittgenstein’s work, he believed also with regards to the arts and to music in particular, neither in a brilliant future nor in the good old days. -/- I argue that Wittgenstein actually made a distinction between three kinds of modern music: (a) bad modern music, which is clearly a case of confusing means for ends, the hallmark of the myth of progress, as Von Wright observed; (b) vacuous modern music, which embodies some sort of diffidence, a difficulty to see through the omnipresence of what Von Wright called (following Habermas) a ‘colonialization’ of reified measures of progress; (c) good modern music, a paradoxical notion for Wittgenstein, which betokens the unlikely yet possible striving to penetrate through what appears as dissolution of the resemblances which unite this culture’s ways of life by rendering this condition as expressible and intransitively understandable. In the context of this third category, I offer an interpretation of Wittgenstein’s complex remarks on the music of Gustav Mahler, which palpably show that the problem of good modern music and the problem of philosophizing in the time of civilization were one and the same in Wittgenstein’s mind. -/- I conclude that, with regards to Von Wright’s own critical view of the modern myth of progress, we can learn from Wittgenstein that progress in the realm of art is closely aligned with the ideal of the perfection of man, yet transcending a social or political context. It is the ideal of cultural cohesion: affinity that the arts show to other human practices and cultural artifacts of its period. Wittgenstein’s tentative notion of good modern music (and its circumscription by his notion of the music of the future) may show its true colors when viewed in the context of Von Wright’s plea not to abandon work for progress as a critical task. This paper argues for a ‘contextualist’ approach to teaching antisemitism in philosophy class. The traditional ‘systematic’ approach emphasizes recognizing and dismantling antisemitic aspects in canonical philosophical texts. The introduced contextualist approach broadens the perspective, treating philosophy as a continuous debate embedded in cultural realities. It focuses on historical controversies rather than isolated arguments, includes the voice and the perspectives of the oppressed, and so has the potential to broaden traditional philosophical canons. In the second half of the paper, we provide (...) a case study of the contextualist approach, applying it to the ‘Berlin antisemitism controversy’ of 1879/80. We argue that the contextualist approach is particularly valuable when dealing with antisemitism as it teaches students to analyze arguments within the socio-political landscape and to identify antisemitic elements. The students thereby acquire the skills to discern antisemitic argumentation in other contexts as well. We suggest that this approach could be used to teach other debates in the history of philosophy, especially those tackling race, sex, and gender issues. (shrink)

The Marburg neo-Kantians argue that Hermann von Helmholtz's empiricist account of the a priori does not account for certain knowledge, since it is based on a psychological phenomenon, trust in the regularities of nature. They argue that Helmholtz's account raises the 'problem of validity' (Gueltigkeitsproblem): how to establish a warranted claim that observed regularities are based on actual relations. I reconstruct Heinrich Hertz's and Ludwig Wittgenstein's Bild theoretic answer to the problem of validity: that scientists and philosophers can depict (...) the necessary a priori constraints on states of affairs in a given system, and can establish whether these relations are actual relations in nature. The analysis of necessity within a system is a lasting contribution of the Bild theory. However, Hertz and Wittgenstein argue that the logical and mathematical sentences of a Bild are rules, tools for constructing relations, and the rules themselves are meaningless outside the theory. Carnap revises the argument for validity by attempting to give semantic rules for translation between frameworks. Russell and Quine object that pragmatics better accounts for the role of a priori reasoning in translating between frameworks. The conclusion of the tale, then, is a partial vindication of Helmholtz's original account. (shrink)

Die Psychologie hat sich im zweiten Viertel des 19. Jahrhunderts langsam zu einer autonomen Disziplin entwickelt. Im Unterschied zu den anderen Figuren in dieser Entwicklung, Johann Friedrich Herbart, Ernst Heinrich Weber und Gustav Theodor Fechner, hat Lotze in seiner Medicinische Psychologie (1852) von Anfang an die neue Disziplin, die Psychologie, konsequent in enger Verbindung mit der Philosophie entwickelt. Damit hat er die Hoffnung gebremst, die Psychologie völlig experimentellen Untersuchungen zu überlassen, die um diese Zeit schon viele gepflegt haben. Lotze (...) scheute sich jedoch, diese Disziplin „philosophische Psychologie“ zu benennen. Sie war für ihn nur physiologische Psychologie, herausarbeitet mit Hilfe der Philosophie. Sie stellt nur Tatsachen fest, untersucht wie Körper und Seele sich zueinander verhalten und dies nicht nur empirisch, sondern auch „metaphysisch“. (shrink)

Resumen: El presente artículo busca presentar sumariamente las principales críticas elaboradas por Karl Löwith y Leo Strauss en su recepción del clásico trabajo de Carl Schmitt Der Begriff des Politischen [El concepto de lo político]. Se intentará explorar, en un primer apartado, la acusación löwithiana de “ocasionalismo ateológico”, formulada, aunque bajo pseudónimo, en un texto crítico de 1935 cuyo título original fue luego reemplazado por aquel con el que se lo conoce actualmente: Der okkasionelle Dezisionismus von Carl Schmitt [El decisionismo (...) ocasional de Carl Schmitt]. En la segunda sección, siguiendo principalmente la lectura propuesta de Heinrich Meier, se buscará dar cuenta de la interpretación que aparece en los Anmerkungen zu Carl Schmitt, Der Begriff des Politischen [Comentarios sobre El concepto de lo político de Carl Schmitt], las notas de Leo Strauss, publicadas en 1932, que sugieren entender la afirmación de lo político en la obra de Schmitt como constitutiva de la posterior crítica schmittiana de la filosofía política de Thomas Hobbes. In the second section, following mainly the reading of Heinrich Meier, I will seek to give an account of the interpretation present in the Anmerkungen zu Carl Schmitt, Der Begriff des Politischen [Comments on Carl Schmitt’s Concept of the Political], the critical notes by Leo Strauss, published in 1932, which suggest understanding the assertion of politics in Schmitt’s work as constitutive for the later Schmittian critique of Thomas Hobbes’ political philosophy. It is exhibited that maxwellian electrodynamics grew out of the old pre-maxwellian programmes reconciliation: the electrodynamics of Ampere-Weber, the wave theory of Young-Fresnel and Faraday’s scientific research programme. The programmes’ meeting led to construction of the whole hierarchy of theoretical objects starting from the genuine crossbreeds (the displacement current) and up to usual mongrels. After the displacement current invention the interpenetration of the pre-maxwellian programmes began that marked the beginning of theoretical schemes of optics and electromagnetism real unification. Maxwell’s programme (...) did supersede its rivals because it had assimilated some ideas of the Ampere-Weber programme, as well as the presuppositions of the programmes of Young-Fresnel and Faraday. Maxwellian programme’s victory over its rivals became possible because the core of Maxwell’s unification strategy was formed by Kantian epistemology looked through the prism of William Whewell and such representatives of Scottish Enlightenment as Thomas Reid and William Hamilton. It was Kantian epistemology that enabled Hermann von Helmholtz and Heinrich Hertz to arrive at such a version of Maxwell’s theory that could serve a heuristical basis for the radio waves discovery. Maxwellian electrodynamics genesis is considered in the light of the author’s theory change model previously tried on the Copernican and the Einstein revolutions. It is shown that in the case considered a genuine new theory is constructed as a result of the old pre-maxwellian programmes reconciliation: the electrodynamics of Ampere-Weber, the wave theory of Fresnel and Young and Faraday’s programme. The “neutral language” constructed for the comparison of the consequences of the theories from these programmes consisted in the language of (...) hydrodynamics with its rich content of analogous models ranging from the uncompressible fluid up to molecular vortices. The programmes’ meeting led to construction of the whole hierarchy of crossbred objects beginning from the displacement current and up to common hybrids. After that the interpenetration of the pre-maxwellian programmes began that marked the beginning of theoretical schemes of optics and electromagnetism unification. Maxwell’s programme did assimilate some ideas of the Ampere-Weber programme, as well as the presuppositions of the programmes of Fresnel and Faraday; and the significance of this fact for further methodology of scientific research programmes development is discussed. It is argued that the core of Maxwell’s unification strategy was formed by Kantian epistemology looked through the prism of William Whewell and such representatives of Scottish Enlightenment as Thomas Reid and William Hamilton. All these enabled Maxwell to start to unify not only optics and electromagnetism, but British and continental research traditions as well. Maxwell’s programme did supersede the Ampere-Weber one because Maxwell did put forward as a synthetic principle the idea, that differed from that of Ampere-Weber by its flexible and contra-ontological, strictly epistemological, Kantian character. For Maxwell, ether was not the last building block of physical reality, from which fields and charges should be constructed . “Action at a distance”, “incompressible fluid”, “molecular vortices” were only analogies for Maxwell, capable to direct the researcher on the “right” mathematical relations. From the “representational” point of view all this hydrodynamical models were doomed to failure efforts to describe what can not be described in principle – things in themselves, the “nature” of electrical and magnetic phenomena. On the contrary, Maxwell aimed his programme to find empirically meaningful mathematical relations between the electrodynamics basic objects, i.e. the creation of inter - coordinated electromagnetic field equations system. Namely the application of this epistemology enabled Hermann von Helmholtz and his pupil Heinrich Hertz to arrive at such a version of Maxwell’s theory that served a heuristical basis for the radiowaves discovery. Der Autor des Artikels sucht die Kategorie der literarischen, Moderne in ihrer Abhängigkeit von der gesellschaftlichen Moderne zu analysieren. Nach der Feststellung, daß sich diese umstrittene Kategorie jedem definitorischen Zugriff entzieht, werden verschiedene Deutungsmöglichkeiten dieses Begriffs variiert, die Moderne als das Modische, das jeweils Moderne, das Neue und die Gegenwärtige wird der Moderne im Sinne Friedrich Schlegels, die sich vom Klassischen absetzt, gegenübergestellt. Die Verstehensmöglichkeiten des Begriffs „Moderne” werden am Beispiel der „Freien literarischen Vereinigung” „Durch” diskutiert. Passagen aus den Aufsätzen (...) von Heinrich Hart und Hermann Bahr werden zitiert. Die Entstehung der literarischen Moderne wird als Folge jener Entwicklung auf dem Feld der Naturwissenschaften und der Technik betrachtet, die den Menschen zum Beherrscher und Hersteller der Welt werden ließen. Technik und Ergebnisse der. Naturwissenschaften werden im Naturalismus dargestellt. Dieser zeigte aber den Menschen als Produkt der sozialen und psychischen Bedingungen und entspricht nicht den Forderungen, die Hermann Bahr an die Moderne stellte. Im letzten Teil des Artikels werden zahlreiche Beispiele aus der neusten Literatur angegeben, die die These unterstützen sollen, daß die Hauptmerkmale der Moderne die geschlossenen Weltbilder aufheben und sich in den „offenen Kunstwerken” in der semiotischen Form der freien Produktivität manifestieren. The aim of this paper is to show that a comprehensive account of the role of representations in science should reconsider some neglected theses of the classical philosophy of science proposed in the first decades of the 20th century. More precisely, it is argued that the accounts of Helmholtz and Hertz may be taken as prototypes of representational accounts in which structure preservation plays an essential role. Following Reichenbach, structure-preserving representations provide a useful device for formulating an up-to-date version of (...) a (relativized) Kantian a priori. An essential feature of modern scientific representations is their mathematical character. That is, representations can be conceived as (partially) structure-preserving maps or functions. This observation suggests an interesting but neglected perspective on the history and philosophy of this concept, namely, that structure-preserving representations are closely related to a priori elements of scientific knowledge. Reichenbach’s early theory of a relativized constitutive but non-apodictic a priori component of scientific knowledge provides a further elaboration of Kantian aspects of scientific representation. To cope with the dynamic aspects of the evolution of scientific knowledge, Cassirer proposed a re-interpretation of the concept of representation that conceived of a particular representation as only one phase in a continuous process determined by pragmatic considerations. Pragmatic aspects of representations are further elaborated in the classical account of C.I. Lewis and the more modern of Hasok Chang. (shrink)

This article will offer an alternative understanding of managerial decision-making drawing from Sartre’s Critique of Dialectical Reason rather than simply Being and Nothingness. I will begin with a brief explanation of Sartre’s account of freedom in Being and Nothingness. I will then show in the second section how Andrew West uses Sartre’s conception of radical freedom from Being and Nothingness for a managerial decision-making model. In the third section, I will explore a more robust account of freedom from Sartre’s Critique (...) of Dialectical Reason. I will attempt to show that freedom is not simply a matter of choosing (or not choosing) to perform an action, but entails external constraints—including other people. Finally, I will provide the implications of this account of freedom for managerial decision-making. I will show that it’s unreasonable to place full responsibility and/or blame on managers given their constraints. This does not absolve them from responsibility, but better accounts for the way in which we ought to hold them responsible. (shrink)

An inverse akratic act is one who believes X, all things considered, is the correct act, and yet performs ~X, where ~X is the correct act. A famous example of such a person is Huck Finn. He believes that he is wrong in helping Jim, and yet continues to do so. In this paper I investigate Huck’s nature to see why he performs such acts contrary to his beliefs. In doing so, I explore the nature of empathy and show how (...) powerful Huck’s empathic feelings are. Drawing from Martin L. Hoffman, I show the relationship between empathy and a principle of justice. This relationship leads to Huck acting virtuously, as Rosalind Hursthouse maintains. (shrink)

Responsible Research and Innovation (RRI) reflects an innovation paradigm that acknowledges that market innovations do not automatically deliver on socially desirable objectives, and requires a broad governance of knowledge coalitions of governmental bodies as well as industrial and societal actors to address market deficits. Responsible Innovation should be understood as a new paradigm for innovation which requires institutional changes in the research and innovation system and the public governance of the economy. It also requires the institutionalisation of an ethics of (...) co-responsibility as well as the introduction of new standards and certification processes for products. We consider the prospects for RRI within the context of the EC’s Open Science agenda (...) and Horizon Europe programme, before closing with some reflections on the contribution RRI has made to debates concerning the relationship between science, innovation and society over the last decade. This paper responds to the Radical Behavioral Challenge to normative business ethics. According to RBC, recent research on bounded ethicality shows that it is psychologically impossible for people to follow the prescriptions of normative business ethics. Thus, said prescriptions run afoul of the principle that nobody has an obligation to do something that they cannot do. I show that the only explicit response to this challenge in the business ethics literature is flawed because it limits normative business ethics to condemning (...) practitioners’ behavior without providing usable suggestions for how to do better. I argue that a more satisfying response is to, first, recognize that most obligations in business are wide-scope which, second, implies that there are multiple ways of fulfilling them. This provides a solid theoretical grounding for the increasingly popular view that we have obligations to erect institutional safeguards when bounded ethicality is likely to interfere with our ability to do what is right. I conclude with examples of such safeguards and some advice on how to use the research findings on bounded ethicality in designing ethical business organizations. (shrink)

Among recent developments in the anthropological sciences, hardly any have found so much attention and led to so much controversy as have the views advanced by the late Benjamin Whorf.The hypothesis offered by Whorf is,“that the commonly held belief that the cognitive processes of all human beings possess a common logical structure which operates prior to and independently of communication through language, is erroneous. It is Whorf's view that the linguistic patterns themselves determine what the individual perceives in this world (...) and how he thinks about it. Since these patterns vary widely, the modes of thinking and perceiving in groups utilizing different linguistic systems will result in basically different world views”.“We are thus introduced to a new principle of relativity which holds that all observers are not led by the same physical evidence to the same picture of the universe, unless their linguistic backgrounds are similar. … We cut up and organize the spread and flow of events as we do largely because, through our mother tongue, we are parties to an agreement to do so, not because nature itself is segmented in exactly that way for all to see”. This Article outlines a vision of responsible innovation and outlines a public policy and implementation strategy for it.

According to the order ethics approach to business ethics, moral rules must be im-plemented by institutions that provide incentives for following the rules. As a minimal (normative) condition, these institutions must be able to motivate the homo eco-nomicus. But even if an institution passes this test, it will only motivate actual people (i.e. the homo psychologicus) to follow moral rules, if they have the relevant compe-tences and self-efficacy beliefs. Consequently, good institutional design includes com-prehensive change management. At this point applied (...) order ethics can draw on find-ings of psychology and experimental economics. It turns out, that role models can support self-efficacy beliefs and are thus more important for order ethics than has traditionally been assumed. (shrink)

Driven by a sharp increase in claims for reparations, reparative justice has become a topic of academic debate. To some extent this debate has been marred by a failure to realize the complexity of reparative justice. In this essay we try to amend this shortcoming. We do this by developing a taxonomy of different kinds of wrongs that can underwrite claims to reparations. We identify four kinds of wrongs: entitlement violations, unjust exclusions from an otherwise acceptable system of entitlements, and (...) two kinds where a social practice systematically fails to embody an acceptable system of entitlements. In deliberation about what is required to repair a historical injustice the weight of backward- and forward-looking considerations is a function of the distinctive features of the injustice in question. Hence, the first step in adjudicating claims for reparation is to identify what kind of wrong the claim arises from. From the taxonomy of wrongs we are thus able to construct what we call the Field of Reparative Justice, which illustrates how the structure of deliberation for reparative justice tracks the distinctive features of different kinds of wrongs. Achievements have recently begun to attract increased attention from value theorists. One recurring idea in this budding literature is that one important factor determining the magnitude or value of an achievement is the amount of effort the achiever invested. The aim of this paper is to present the most plausible version of this idea. This advances the current state of debate where authors are invoking substantially different notions of effort and are thus talking past each other. While the concept of (...) effort has been invoked in the philosophical analysis of a number of important concepts such as desert, attention, competence, and distributive justice, it has hardly ever been analyzed itself. This paper makes headway in this regard by discussing three ambiguities in the everyday notion of effort. It continues to develop two accounts of effort and shows how both of them are achievement-enhancing. (shrink)

This paper critically assesses existing accounts of the nature of difficulty, finds them wanting, and proposes a new account. The concept of difficulty is routinely invoked in debates regarding degrees of moral responsibility, and the value of achievement. Until recently, however, there has not been any sustained attempt to provide an account of the nature of difficulty itself. This has changed with Gwen Bradford’s Achievement, which argues that difficulty is a matter of how much intense effort is expended. But while (...) this account captures something important about the relationship between difficulty and achievement, it fails to account for the fact that part of what makes achievements great is that they are difficult in a moderately agent-neutral kind of way. Nor is this thought captured by any other extant account. I argue that to fill this gap we should think of difficulty in terms of low probability of success. (shrink)

Business ethics denial refers to one of two claims about moral motivation in a business context: that there is no need for it, or that it is impossible. Neither of these radical claims is endorsed by serious theorists in the academic fields that study business ethics. Nevertheless, public commentators, as well as university students, often make claims that seem to imply that they subscribe to some form of business ethics denial. This paper fills a gap by making explicit both the (...) various forms that business ethics denial can take, and the reasons why such views are ultimately implausible. The paper argues that this type of serious engagement with business ethics denial should be an important part of the job description for teachers of business ethics. (shrink)

Theories of well-being that give an important role to satisfied pro-attitudes need to account for the fact that, intuitively, the scope of possible objects of pro-attitudes seems much wider than the scope of things, states, or events that affect our well-being. Parfit famously illustrated this with his wish that a stranger may recover from an illness: it seems implausible that the stranger’s recovery would constitute a benefit for Parfit. There is no consensus in the literature about how to rule out (...) such well-being-irrelevant pro-attitudes. I argue, first, that there is no distinction in kind between well-being-relevant and irrelevant pro-attitudes. Instead, well-being-irrelevant pro-attitudes are the limiting cases on the scale measuring how much of a difference pro-attitudes make to the subject’s well-being. Second, I propose a particular scalar model according to which the well-being-relevance of pro-attitudes is measured by either their hedonic tone, or by the subject’s conative commitment. (shrink)

Some have tried to make miracles compatible with the laws of nature by re-defining them as something other than interventions. By contrast, this article argues that although miracles are divine interventions, they are not violations of the laws of nature. Miracles are also not exceptions to the laws, nor do the laws not apply to them. The laws never have exceptions; they never are violated or suspended, are probably necessary and unchangeable, and apply also to divine interventions. We need to (...) reconsider not miracles but laws. The main claim of this article is that laws of nature do not entail regularities, and therefore that miracles do not violate the laws. We need a new theory of the laws of nature: the tendency theory. (shrink)

According to the Market Failures Approach to business ethics, beyond-compliance duties can be derived by employing the same rationale and arguments that justify state regulation of economic conduct. Very roughly the idea is that managers have a duty to behave as if they were complying with an ideal regulatory regime ensuring Pareto-optimal market outcomes. Proponents of the approach argue that managers have a professional duty not to undermine the institutional setting that defines their role, namely the competitive market. This answer (...) is inadequate, however, for it is the hierarchical firm, rather than the competitive market, that defines the role of corporate managers and shapes their professional obligations. Thus, if the obligations that the market failures approach generates are to apply to managers, they must do so in an indirect way. I suggest that the obligations the market failures approach generates directly apply to shareholders. Managers, in turn, inherit these obligations as part of their duties as loyal agents. (shrink)

ABSTRACTAchievements are among the things that make a life good. Assessing the plausibility of this intuitive claim requires an account of the nature of achievements. One necessary condition for achievement appears to be that the achieving agent acted competently, i.e. was not just lucky. I begin by critically assessing existing accounts of anti-luck conditions for achievements in both the ethics and epistemology literature. My own proposal is that a goal is reached competently, only if the actions of the would-be-achiever make (...) success likely, and that this is the reason why she acts that way. (shrink)

This article argues that agents can initiate causal processes.

I argue how Filipino philosophy is an illusion we have taken as a belief, and that we need to remember again its illusory – but necessary – status for it to flourish. The normativity of this illusion impelled the discourse: what is philosophy? For new directions, the language of Filipino philosophy must be negative that pathologies in thinking be realized; it is a necessary illusion remembered once more: a nihilistic stance for new values to be created. I raise the question (...) of the non-identical character of language, of how nature is far larger than concepts, which makes misrepresentation possible (something evident in society—leaders to population, praxis to theory, philosophy to culture). The non-identicality reifies the illusion into belief which necessitates a decadent type of rationality. The illusory status of the nomenclature (‘Filipino philosophy’) must be remembered again for the dialectic to continue. In seeking new directions for Filipino philosophy, it is not enough that a new breed of thinkers merely accepts the value ascribed to it – along with the numerous errors and nuisances inherited along the way – but to create new value. With a critical stance, I present 5 assumptions that probe into some essential characteristics of the immanent pathologies of Filipino philosophy’s language that occasions the need for such struggle branded as assumptions. Dieser Aufsatz behauptet hin- gegen, daß Wunder die Naturgesetze nicht verletzen, obwohl sie göttliche Eingriffe sind. Wunder sind auch keine „Ausnah- men“ der Naturgesetze, noch treffen die Naturgesetze nicht auf sie zu. Naturgesetze haben nie Ausnahmen, sie werden nie verletzt oder ausgesetzt, sie sind wahrscheinlich notwen- dig und unveränderlich, und sie treffen auch auf göttliche Ein- griffe zu. Wir sollten nicht unsere (...) Vorstellung von Wundern, sondern unsere Vorstellung der Naturgesetze in Frage stel- len. Die Hauptthese dieses Aufsatzes ist, daß Naturgesetze keine Abfolgeregelmäßigkeiten implizieren und daß deshalb Wunder die Naturgesetze nicht verletzen. Praised as a panacea for resolving all societal issues, and self-evidently presupposed as technological innovation, the concept of innovation has become the emblem of our age. This is especially reflected in the context of the European Union, where it is considered to play a central role in both strengthening the economy and confronting the current environmental crisis. The pressing question is how technological innovation can be steered into the right direction. To this end, recent frameworks of Responsible Innovation focus on (...) how to enable outcomes of innovation processes to become societally desirable and ethically acceptable. However, questions with regard to the technological nature of these innovation processes are rarely raised. For this reason, this paper raises the following research question: To what extent is RI possible in the current age, where the concept of innovation is predominantly presupposed as technological innovation? On the one hand, we depart from a post-phenomenological perspective to evaluate the possibility of RI in relation to the particular technological innovations discussed in the RI literature. On the other hand, we emphasize the central role innovation plays in the current age, and suggest that the presupposed concept of innovation projects a techno-economic paradigm. In doing so, we ultimately argue that in the attempt to steer innovation, frameworks of RI are in fact steered by the techno-economic paradigm inherent in the presupposed concept of innovation. Finally, we account for what implications this has for the societal purpose of RI. (shrink)

Sie will sich nicht vom Christentum offen absagen, sondern das Christentum verändern oder eine neue Version des Christentums einführen. Radical Orthodoxy (RO), vor allem von John Milbank gegründet, will eine Gegenbewegung dazu sowie zum Säkularismus sein: „A theology which claims to be radical and orthodox“. In diesem Aufsatz möchte ich untersuchen, ob sie es wirklich ist, und (...) ich werde Indizien dafür vorstellen, daß sie es nicht ist. It is widely held that our beliefs can be epistemically faultless despite being morally flawed. Theories of moral encroachment challenge this, holding that moral considerations bear on the epistemic status of our attitudes. According to attitude-based theories of moral encroachment, morality encroaches upon the epistemic standing of our attitudes on the grounds that we can morally injure others with our epistemic practices. In this paper, I aim to show that current attitude-based theories have asymmetric mechanisms: moral features only make it (...) harder for attitudes to secure epistemic merits. I argue that, if attitudes can incur moral injury, failure to form attitudes can too. To make sense of this, I contend, attitude-based accounts require symmetric mechanisms, allowing that moral considerations make it both harder and easier for attitudes to attain epistemic merits. I maintain that, once we recognize this, attitude-based encroachment views must soon concede that they sometimes demand we believe against the evidence. (shrink)
